Terms and Conditions

Tenant Services

Tenants can create profile listings describing themselves, their preferences, budget, and what they are looking for in accommodation. These profiles are visible to Providers.

Provider Services

Providers (individuals, companies, partners, coliving spaces, or property owners) can publish listings about their available accommodations, including details about the property (house, apartment, etc.), house rules, amenities, room specifications, prices, and availability.

Connection Services

Users can view each other's profiles and request to connect. Upon mutual agreement, Users gain access to a messaging system to communicate directly.

Verification Services

We use Veriff, a third-party identity verification service, to verify User identities. Use of this service is subject to Veriff's own terms and conditions.

Limitations

Colochub does not:

• Act as a real estate agency or property manager
• Guarantee the quality, safety, or legality of listed accommodations
• Participate in negotiations or transactions between Users
• Handle payments between Users
• Verify the accuracy of all information provided by Users
• Guarantee the compatibility of connected Users

Registration Requirements

To use our services, you must:

• Be at least 18 years old
• Provide accurate, current, and complete information
• Maintain and promptly update your account information
• Keep your login credentials confidential

Account Responsibility

You are solely responsible for:

• All activities that occur under your account
• Maintaining the confidentiality of your password
• Notifying us immediately of any unauthorized use of your account

Account Verification

By using our verification service, you:

• Consent to the collection and processing of your identification documents
• Agree to provide truthful information and authentic documents
• Understand that verification is subject to approval and may be rejected

Content Responsibility

You warrant that:

• You own or have the necessary rights to the Content you post
• Your Content is accurate and not misleading
• Your Content does not violate these Terms or applicable laws

Prohibited Content

Content that is:

• Is false, inaccurate, or misleading
• Is discriminatory based on race, gender, religion, nationality, disability, sexual orientation, or age
• Infringes on intellectual property rights
• Contains personal data of third parties without their consent
• Is defamatory, obscene, pornographic, or offensive
• Promotes illegal activities
• Contains software viruses or harmful code

Prohibited Conduct

You must not:

• Violate any applicable law or regulation
• Impersonate any person or entity
• Harvest or collect user information
• Interfere with the proper functioning of the Platform
• Circumvent any measures used to prevent or restrict access to the Platform
• Engage in any activity that could damage, disable, or impair the Platform

Content Removal

We reserve the right to remove any Content that violates these Terms or that we find objectionable for any reason, without prior notice.

Platform Intellectual Property

All intellectual property rights in the Platform, including but not limited to software, design, logos, and content created by Colochub, are owned by Colochub or its licensors.

License to User Content

By posting Content on the Platform, you grant Colochub a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, adapt, publish, translate, and distribute your Content for the purpose of providing and promoting our services. This includes using your profile, feedback, and pictures for our advertising campaigns.

User Content Ownership

You retain all ownership rights to your Content, subject to the license granted to Colochub.

Data Processing

We collect and process personal data in accordance with our Privacy Policy and applicable data protection laws, including the General Data Protection Regulation (GDPR).

Communication

By creating an account, you consent to receive communications from us related to your account and our services. You can opt out of non-essential communications.

Third-Party Services

Our use of Veriff for identity verification involves the transfer of personal data to this third party. This transfer is governed by our Privacy Policy and Veriff's terms and conditions.

Service Provision

The Platform is provided on an "as is" and "as available" basis. We do not guarantee that the Platform will be uninterrupted, timely, secure, or error-free.

User Interactions

We are not responsible for:

• The conduct of Users on or off the Platform
• The content of communications between Users
• Any transactions between Users
• Any damages resulting from your use of the Platform or interactions with other Users

Verification Limitations

We cannot guarantee:

• The accuracy of verification results
• The identity, integrity, or conduct of any User
• The safety of interactions between Users

Liability Cap

To the maximum extent permitted by law, Colochub's total liability for any claims related to these Terms or your use of the Platform shall not exceed the amount you have paid to Colochub (if any) in the twelve months preceding the claim.

Termination by Users

You may terminate your account at any time by following the instructions on the Platform or by contacting us at contact@colochub.be.

Termination by Colochub

We can terminate your account:

• If you violate these Terms
• If you provide inaccurate, fraudulent, or incomplete information
• If we believe your actions may cause legal liability for you, other Users, or Colochub
• For any other reason at our sole discretion

Effects of Termination

Upon termination:

• Your access to the Platform will be disabled
• Your listings will be removed from the Platform
• We may retain certain information as required by law or for legitimate business purposes

Modifications

We may modify these Terms at any time by posting the revised version on the Platform. The revised Terms will be effective immediately upon posting.

Notification

We will make reasonable efforts to notify you of significant changes to these Terms. Continued use of the Platform after changes constitutes acceptance of the revised Terms.

Governing Law

These Terms are governed by and construed in accordance with the laws of Belgium, without regard to its conflict of law principles.

Dispute Resolution

Any dispute arising from these Terms or your use of the Platform shall be subject to the exclusive jurisdiction of the courts of Belgium.

Informal Resolution

Before filing a claim, you agree to attempt to resolve the dispute informally by contacting us at contact@colochub.be. We will attempt to resolve the dispute by contacting you via email.

Entire Agreement

These Terms constitute the entire agreement between you and Colochub regarding your use of the Platform and supersede any prior agreements.

Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full force and effect.

No Waiver

Our failure to enforce any right or provision of these Terms will not be considered a waiver of such right or provision.

Assignment

You may not assign your rights under these Terms without our prior written consent. We may assign our rights under these Terms without restriction.

Force Majeure

Colochub shall not be liable for any failure to perform its obligations where such failure is a result of events beyond its reasonable control.
